1. Introduction and effectiveness of the General Conditions

These General Conditions of Sale (hereinafter referred to as “General Conditions”) concern the regulation of the purchase of products and services, made at a distance and made available, via the internet, from the website www.hairbeautyshop.eu (hereinafter referred to as “Site“) in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code“).

The seller of the products and owner of the Site has its registered office in Via Colle Fiorito, 2, 00045 Genzano di Roma (Rm) – E-mail address: info@hairbeautyshop.it (hereinafter “HAIR BEAUTY SHOP“).

The consumer who accesses the Site to make purchases (hereinafter “Customer“) is required, before sending the order, to carefully read these General Conditions that have been made available to you on the Site and that will be available at any time by the Customer through the link contained in the email confirmation of each order to allow the reproduction and memorization.

In the event that the person making purchases on the Site requires the issuance of an invoice and/or in any case is not a “consumer or user” (as defined in art. 3, paragraph 1, lett. a, of the Consumer Code), the provisions of the withdrawal pursuant to art. 7 and 8 of these General Conditions nor, more generally, the provisions that pursuant to the same Consumer Code apply only to “consumers”.

The contracts concluded with Hair Beauty Shop through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is English.

 

2. Choosing and ordering Products

The characteristics and price of the various products sold on the Site (hereinafter “Product” or “Products”) are shown on the page for each Product.

To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained in the Site. The Customer must add the Product to the “Cart” and, after having read the General Conditions and the Privacy Policy and confirmed their acceptance, must enter the shipping data and any billing, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares that he has read all the information provided to him during the purchase procedure and to accept in full these General Conditions and transcribed payment.

The contract between Hair Beauty Shop and the Customer is concluded with the acceptance of the order by Hair Beauty Shop. This acceptance is communicated to the Customer through an email confirming the order containing a reference to these General Conditions, the order number, shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including delivery costs. Once the contract is concluded, Hair Beauty Shop will take charge of the purchase order and the buyer can view the orders made, accessing his profile and consulting the appropriate section.

Once the order has been received, Hair Beauty Shop will check the availability of the stock for the order. In the event that one or more Products are not available, the Hair Beauty Shop Customer Service will send timely communication by email to the Customer, within the next 12 hours, will be entitled to respond to confirm the shipment of any additional Products available or cancel it. If you do not reply within this period, the order will be considered confirmed and the available Products will be shipped. In this case, the entire amount relating to the missing Products will be cancelled or in any case, depending on the payment method chosen, will not be charged to the Customer.

We recommend that you group your items in one order. We can not group two separate orders executed separately, and each of them will be charged shipping costs (for orders less than € 49.90 VAT included ). Your package will be sent under your responsibility, but special attention is paid to fragile objects.

For each order made, hairbeautyshop.eu issues sales document of the material shipped. For the issuance of the invoice, the information provided by the customer at the time of the order is authentic. The customer is required to update the tax data, shipping address or other changes that occurred further registration.  The customer may request a copy of the invoice within three months of its issue.

No liability can be attributed to hairbeautyshop.eu in case of delay in the order processing or delivery of the order.

 

3. Information on Products

The information and characteristics relating to the Products are available on the Site.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In case of difference between the image and the written product sheet, the description of the product sheet is always valid.

 

4. Prices and shipments

There is no minimum order to make purchases on the Site. Product prices include all taxes and duties. All prices are in Euro.

Shipments:

Express Courier – Delivery within 72h: € 6,90

The cost of shipping is FREE for orders equal to or greater than € 49.90.

At the time of delivery the customer is required to check:

– the packaging is intact and sealed with our safety tape, neither damaged, wet, or otherwise altered;

– the number of packages corresponds to that indicated in the transport document.

Any damage to the product or packaging or the mismatch of the numbers of packages received, must be immediately challenged to the courier by placing “RESERVATION OF WRITTEN CHECK”, on the courier’s delivery proof. Once the courier document has been signed, the customer will not be able to object to the external characteristics of the delivered goods.

In the event of failure to collect within 5 working days of the material in stock at the courier stores due to repeated impossibility of delivery to the address indicated by the customer at the time of order, the order will be cancelled and any storage costs will be charged to the customer.

 

5. Methods of payment and invoicing

5.1 Methods of payment

The Customer may pay the price of the Products and the related delivery costs by PayPal, Bank Transfer, Credit or Debit Cards (Stripe).

 

PayPal

Once the order is confirmed, the Customer will be redirected to the PayPal website where he can make the payment with his account or using a card, also prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relevant conditions.

Purchased products will be shipped within 48 hours of receipt of payment.

 

Credit or debit cards (Stripe)

You can pay by credit or debit card by selecting the appropriate item and filling in the fields related to the card.

 

5.2 Invoicing of orders

If the purchase is made by a professional or a company, it will be possible to request the issue of the invoice by selecting the appropriate box during the order procedure and entering the billing data including tax code, VAT number, unique code and/or PEC. In this case, the invoice will be sent by email to the address indicated. The professional is responsible for the correct entry of the billing data and is expressly informed that, in case of failure to request the invoice during the order, it will not be possible to request it later.

 

6. Transport and Delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate field.

All purchases will be delivered by courier. Hair Beauty Shop is not responsible for delays not foreseeable or not attributable to it.

Once the Products have been shipped, the Customer will receive a confirmation email that will include a link to refer to for shipment tracking.

In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a period of 3 (THREE) working days from the day following that in which Hair Beauty Shop will receive payment from the Customer.

6.1 Delivery and storage

The address entered in the checkout phase cannot be changed in any way once received by the order receiving system.

The service includes 2 delivery attempts at the address indicated at the time of the order and it will not be possible to store the package, which will automatically return to headquarters.

If the customer requests the delivery of his order again, he will have to bear the transport costs at the ordinary cost (see shipping costs point 4). Please then enter a secure address for pickup.

 

7. Right of withdrawal

The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except in the cases of exclusion provided for in point IV below. To exercise this right before the shipment of the purchase, the Customer must send to Hair Beauty Shop a communication by e-mail to info@hairbeautyshop.it for the cancellation of the order.

In the event of withdrawal after shipment or delivery of the purchased goods, you can withdraw within 14 days from the date of receipt of the Products, making an express request to be sent by registered letter A/R, addressed to:

The Hair Beauty Shop Customer Service will, once received the communication, open a file for the return management and communicate to the Customer the instructions on how to return the Products.

The right of withdrawal is governed by the following conditions:

I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the right of withdrawal only on part of the Product purchased.

II. In case of exercise of the right of withdrawal Hair Beauty Shop will refund to the customer the full amount of the returned goods, excluding shipping costs that remain at the customer’s expense, within 14 days from the date on which the cancellation notice was received, without prejudice to the right of Hair Beauty Shop to suspend the payment of the refund until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method.

III. Also in order to be able to guarantee the return pursuant to article 8 below, the products must be returned in the same box in which they were received.
 
IV. In addition to the cases indicated in the Foreword (non-consumer customer and/or requesting the invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 d.lgs 21/2014 Italian:
 
– Order custom-made or clearly customized Products;
 
– Order of sealed Products that are not suitable for return for hygienic or health protection reasons or that have been opened after delivery;
 
– Product damaged for reasons other than its transport.
 
In cases of exclusion of the right of withdrawal, Hair Beauty Shop will return to the Customer the Products purchased, charging the same shipping costs.
 
Refunds due to errors not attributable to the company who owns the site, for payments made with paypal, will be deducted before the refund the commission due to the same paypal.
 
8. Free return in case of exercise of the right of withdrawal
As a condition of greater favor for the Customer, with the exception of shipping costs, Hair Beauty Shop retains all packaging and packaging costs in case of exercise of the right of withdrawal.
 
In order to benefit from this right, the Customer who intends to exercise the withdrawal must follow the procedure indicated in article 7 above and ensure the shipment of the goods received for return.
 
 
9. Warranty and Defects
In case of lack of conformity of Products sold by Hair Beauty Shop, the Customer must immediately contact the Customer Service using the appropriate contact form.
 
The legal guarantees provided by articles 129, 130 and 132 of the Italian Consumer Code apply to the sale of the Products. The Customer has the right, at his choice and provided that the type of Product allows it, to restore, at no cost, the conformity of the Product by repair or replacement, or to an appropriate reduction in price or termination of the contract. The Customer forfeits these rights if he does not report to Hair Beauty Shop the lack of conformity within the period of 7 days from the date of delivery, provided that it is not a Product that by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within this reduced period.
 
 
10. Errors and limitations of liability
The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors of which, therefore, Hair Beauty Shop cannot be held responsible, except in case of intentional or gross negligence.
 
Hair Beauty Shop reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update the information at any time without prior notice, without prejudice to the Customer’s rights under these General Conditions and the Consumer Code.
 
Except for intentional or gross negligence, the Customer’s right to compensation or the recognition of compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or fulfilment, even partial, of an order.
 
 
11. Complaints
Any complaint must be forwarded to Hair Beauty Shop using the appropriate contact form, or by registered letter A/R at the following address:

Hair Beauty Shop is committed to respond to all requests received within a maximum of 7 working days.
 
 
12. Applicable law and place of jurisdiction
The contract of sale between the Customer and Hair Beauty Shop is concluded and regulated by Italian law. For the resolution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders if the Customer is a consumer within the meaning of the Consumer Code, will have exclusive jurisdiction over the jurisdiction of its municipality of residence or domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Velletri (Italy – Rome), any other jurisdiction excluded.

Pursuant to Article 1341 of the Italian Civil Code, the Customer declares that it has read and specifically accepts the following articles of these General Conditions: 6 (liability for delays in delivery), 10 (right to correct errors – exclusions of liability).
